Privacy Policy
This Privacy Policy describes how Safety84 LLC ("Safety84," "we," "us," or "our") collects, uses, stores, discloses and protects information in connection with safety84.com, our Telegram channel, our communications, and the compliance management and carrier risk intelligence services we provide (together, the "Services").
By using our website or Services, you acknowledge that you have read and understood this Policy.
1. Scope
This Policy applies to information we receive through the Services — for example when carriers, brokers, 3PLs, shippers, their employees or representatives visit our website, submit a request form, message us, call or email us, or provide records to us in the course of an engagement.
2. Information We Collect
Information you provide
- contact and business details: name, company, email, phone, USDOT/MC number, request type;
- billing details necessary to invoice for the Services;
- records provided so we can perform the work — for example driver files, motor vehicle records, PSP reports, medical certificates, testing records, hours-of-service data, maintenance records, registrations, filings, contracts, rate confirmations and correspondence;
- messages you send us by form, email, phone or Telegram.
Information collected automatically
When you visit safety84.com, we and our providers may receive technical data such as IP address, browser and device type, pages viewed, referring pages, and dates and times of access.
Information from third parties and public records
In performing compliance and carrier risk work we obtain information from sources you authorize or that are publicly available — for example FMCSA systems and the Drug & Alcohol Clearinghouse, state agencies and corporate registries, consumer reporting agencies, testing laboratories and clinics, ELD providers, insurers and payment processors.
3. Records About Drivers and Third Parties
Clients routinely provide us with records relating to their drivers, applicants, employees and contractors, and — in carrier risk engagements — information about other businesses and their representatives. We process such records solely to perform the Services for the client.
The client is responsible for ensuring it has the legal right, required consents and any notices needed under applicable law (including FCRA and DOT regulations, where relevant) to collect such records and share them with us.
Carrier risk assessments are prepared for business-to-business risk-management purposes. They are not consumer reports and are not intended for use in decisions about consumer credit, insurance eligibility for individuals, employment of individuals or other purposes governed by the Fair Credit Reporting Act.
4. How We Use Information
- to provide, operate and improve the Services and website;
- to perform engaged work — maintaining files, submitting filings and registrations, coordinating testing, monitoring records, researching public sources and preparing assessments and reports;
- to respond to inquiries and provide support;
- to send service, billing, legal and security communications;
- to invoice and process payments;
- to secure and troubleshoot our systems;
- to comply with legal obligations and enforce our agreements.
We do not claim ownership of records our clients provide, and we do not sell personal information.
5. Cookies
Our website uses only what is necessary to serve pages and measure basic performance. You can manage cookies through your browser settings; disabling them may affect how parts of the site work.
6. How We Disclose Information
Service providers
We may share information with vendors performing functions on our behalf — hosting, communications, document storage, payment processing and technical support — under obligations to protect it.
To carry out your instructions
We disclose information as necessary to perform engaged work, for example submitting filings to FMCSA, the IRS or state agencies, ordering reports, enrolling drivers in a testing consortium, or corresponding with your insurer or provider.
Legal compliance and protection
We may disclose information where we believe in good faith it is necessary to comply with law, regulation or legal process; to enforce our agreements; or to protect the rights, property or safety of Safety84, our clients or others.
Business transfers
Information may be transferred as part of a merger, acquisition, financing or sale of assets involving our business.
Mobile and messaging information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Sharing with subcontractors that support our services, such as customer service or technical support providers, is permitted. Text messaging originator opt-in data and consent will not be shared with any third parties.
7. Confidentiality of Engagements
Carrier risk and compliance engagements are treated as confidential. We do not disclose the existence or contents of an engagement, or the identity of the requesting client, to the subject of a review or to other parties, except as required by law or as directed by the client.
8. Data Security
We use reasonable administrative, technical and organizational safeguards designed to protect information from unauthorized access, loss, misuse, alteration and disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Data Retention
We keep information for as long as reasonably necessary to provide the Services, meet record-keeping requirements applicable to the work performed, comply with legal obligations, resolve disputes and maintain business records. Backups and system logs may persist for a period after deletion.
10. Your Rights and Choices
Depending on applicable law, you may have rights to access, correct, delete or limit the use of certain personal information. Requests can be sent using the contact details below. Where we hold information solely on behalf of a client, we may refer the request to that client, since the client controls the relevant data.
11. Children's Privacy
Our website and Services are intended for business use and are not directed to children under 13. We do not knowingly collect personal information from children under 13.
12. Third-Party Links and Services
Our website and communications may link to or integrate with third-party services, including Telegram. Their own policies apply to your use of those services.
13. International Use
The Services are intended for use in the United States. If you access them from elsewhere, information may be transferred to and processed in the United States.
14. Changes
We may update this Policy from time to time. For material changes we may provide notice on our website, by email or by other reasonable means.
